PRIVACY POLICY – Elicotte™

1. Who we are
This Privacy Policy explains how Elicotte™, ("Elicotte™", "we", "us"), collects and uses personal data through the online store elicotte.com and related services (the "Services"). The Services are offered exclusively to customers in the European Union and the European Economic Area. We are the data controller of your personal data.

Our store is hosted on Shopify. If this Policy conflicts with our Terms of Service, this Policy prevails for anything about personal data.

2. Personal data we collect

  • Contact details: name, billing and shipping address, email address, phone number.
  • Order and transaction data: products viewed, added to cart, purchased, returned or exchanged; order history.
  • Payment data: payment method and transaction confirmation. Card details are processed directly by our certified payment providers and are never stored by us.
  • Account data: username, password (stored encrypted), preferences and settings.
  • Communications: the content of emails, support requests and other messages you send us.
  • Device and usage data: IP address, browser type, operating system, referring pages, access times and how you navigate the Services, collected through cookies and similar technologies (see Section 5).

You can browse the site without telling us who you are. When we ask for personal data, we tell you which fields are required and which are optional.

3. How we collect it

  • Directly from you: when you place an order, create an account, incomplete checkout, sign up for our newsletter, contact us or submit a support request.
  • Automatically: through your device and browser when you use the Services, including via cookies.
  • From service providers acting on our behalf: Shopify, payment processors, shipping carriers.

4. Why we use your data, and on what legal basis

You need to provide the data required to process an order; without it we cannot complete your purchase. Providing data for marketing purposes is always optional.

5. Cookies
Cookies are small text files that a website stores on your device. Similar technologies, such as pixels, work the same way. We use:

  • Strictly necessary cookies. These are essential for the site to work (cart, checkout, login, security, language). They do not require your consent.
  • Analytics cookies. These help us understand how visitors use the site so we can improve it. Unless they are fully anonymised, we use them only with your consent.
  • Marketing and profiling cookies, our own and third-party (for example Meta, Google). These are used to show you advertising based on your browsing activity, and are placed only with your consent.

On your first visit, a banner lets you accept all cookies, reject all non-essential cookies, or choose by category. Rejecting is as easy as accepting. Closing the banner without making a choice means no non-essential cookies are placed. Continuing to browse or scrolling the page does not count as consent. You can change your choices at any time via [Cookie preferences link in the footer] or in your browser settings.

6. Who we share your data with
We do not sell your personal data. We share it only with:

  • Shopify and our other service providers, who process data on our instructions and under data processing agreements: payment providers, shipping carriers, email marketing platforms, and IT, hosting and customer support providers.
  • Advertising partners (for example Meta, Google), only if you have consented to marketing cookies. They process data under their own privacy policies.
  • Public authorities, when we are required to by law.
  • A buyer or successor, if all or part of our business is sold, merged or transferred. Your data would continue to be protected under this Policy.

Shopify. For certain features, such as fraud prevention, Shop Pay and cross-merchant personalisation, Shopify acts as an independent controller of your data. To learn more, see the Shopify Consumer Privacy Policy and the Shopify Privacy Portal.

7. International transfers
Some of our service providers, including Shopify, Meta and Google, may process personal data outside the EU/EEA. When they do, we make sure your data is protected by appropriate safeguards: European Commission adequacy decisions (such as the EU-US Data Privacy Framework) or the European Commission's Standard Contractual Clauses.

8. How long we keep your data

  • Order, invoicing and accounting data: for the period required by applicable tax and accounting laws.
  • Account data: until you delete your account.
  • Customer support communications: 24 months after your request is closed.
  • Marketing data: until you withdraw your consent or opt out, and in any case no longer than 24 months after your last interaction with us.
  • Cookies: for the periods shown in the cookie banner. Your cookie choices are stored for no longer than 12 months, after which we will ask you again.

When a retention period ends, we delete or anonymise the data.

9. Security
We protect your personal data with appropriate technical and organisational measures: TLS encryption for data in transit, payment processing through PCI-DSS certified providers, and restricted access on a need-to-know basis. No system is completely secure, so please do not send sensitive information to us through unsecured channels.

10. Your rights
Under EU data protection law, you have the right to:

  • access the personal data we hold about you;
  • rectify inaccurate or incomplete data;
  • erase your data;
  • restrict our processing of your data;
  • data portability: receive your data in a structured, commonly used format, or have it transferred to another controller;
  • object to processing based on our legitimate interests, and to direct marketing at any time;
  • withdraw your consent at any time, without affecting processing carried out before you withdrew it.

To exercise any of these rights, contact us at support@elicotte.com. We will reply within one month. We may ask you to verify your identity first. We will never discriminate against you for exercising your rights.

11. Complaints
If you have concerns about how we handle your personal data, please contact us first and we will do our best to resolve them. You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU/EEA country where you live, work, or where you believe an infringement took place. 12. Children
The Services are intended for adults. We do not knowingly collect personal data from minors below the age of digital consent in their country. If you believe a minor has sent us personal data, contact us and we will delete it.

13. Third-party websites
The Services may contain links to third-party websites and social networks. We are not responsible for their content or privacy practices. Please read their privacy policies before sharing any data with them.

14. Changes to this Policy
We may update this Privacy Policy from time to time. The current version is always available on this page, with its "Last updated" date. If we make significant changes, we will notify you by appropriate means.
